Liability waiver
& assumption of risk

I understand that equine activities are inherently dangerous and that being on, near, or around horses carries risks that no amount of care, instruction, or equipment can remove. These risks include, but are not limited to:

• The propensity of a horse to behave in ways that may result in injury, harm, or death to people on or around it;
• The unpredictability of a horse's reaction to sound, sudden movement, unfamiliar objects, people, or other animals;
• Hazards of surface and subsurface conditions, including uneven ground, mud, rocks, and water;
• Collisions with other horses, objects, fencing, or structures;
• The potential for a participant to act in a negligent manner — such as failing to maintain control or not following instructions — that may contribute to injury; and
• Equipment that may fail or be used improperly.

I voluntarily choose to participate with full knowledge of these risks, and I assume all risk of injury, death, or property damage arising from them.

In exchange for being permitted to participate in equine activities at Gracewood Acres, I, on behalf of myself, the participant named above, and our heirs, assigns, and personal representatives, agree as follows:

1. Release. I release, waive, and discharge Gracewood Acres, its owners, members, employees, agents, instructors, and volunteers (the "Released Parties") from any and all liability, claims, demands, or causes of action for injury, death, or property damage arising out of or related to my participation, including claims based on the ordinary negligence of the Released Parties, to the fullest extent permitted by Tennessee law.

2. Assumption of risk. I knowingly and freely assume all such risks, both known and unknown, and assume full responsibility for my participation.

3. Indemnification. I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost they may incur arising out of my participation, whether caused by my own conduct, the conduct of the participant, or otherwise.

4. Medical care. I authorize the Released Parties to arrange emergency medical treatment if needed, and I accept financial responsibility for that care. I confirm I am physically able to participate, or have a physician's approval to do so.

5. Equine Activities Act. I understand this agreement is intended to be consistent with, and in addition to, the protections of the Tennessee Equine Activities Act (TCA Title 44, Chapter 20), and does not limit any protection the Released Parties have under that Act or any other law.

6. Governing law. This agreement is governed by the laws of the State of Tennessee. If any part is found unenforceable, the rest remains in full force. I have read this agreement, understand it is a release of legal rights, and sign it freely.
